Notice from Guangzhou Municipal Planning and Natural Resources Bureau, Guangzhou Municipal Office of the State Administration of Taxation, and Guangzhou Municipal Government Affairs Data Administration on Further Enhancing Full Online Processing of the Registration of Non-Residential Property Transfers Between Enterprises(Sui Gui Hua Zi Yuan Zi [2020] No. 32)

To all parties concerned:

  In order to further improve the business environment in Guangzhou with regards to real estate registration and provide further conveniences to enterprises, the on-site verification procedure will be removed with effect from September 10, 2020 as an upgrade to the existing system which has achieved online application and on-site verification and certificate collection for the transfer of non-residential property between enterprises. Both parties to the transaction are not required to be present on-site, achieving an upgrade from “one trip at most” to “no trips needed”, and realizing “one step, full online processing, and same-day completion” for the whole real estate registration and tax payment process. Relevant matters are hereby notified as follows:

  1.Scope of Application

  The “full online processing” function for the registration of non-residential property transfers between enterprises is built in the Guangzhou Real Estate Registration Online Application System (http://gzbdc.gzlpc.gov.cn:8480/gzwwsq/#/entry). All enterprises that have passed identity verification may complete this procedure through the system.

  The function may be accessed through “Systems → Transaction Systems → Guangzhou Real Estate Registration Online Application System” or “Transaction Channels → Real Estate Registration → Guangzhou Real Estate Registration Online Application System” on the official website of the Guangzhou Municipal Planning and Natural Resources Bureau.

  2. Procedures

  After both parties have formed an intent for transaction, they may submit an application for registration through the Guangzhou Real Estate Registration Online Application System, verify and pay applicable taxes online, and complete the transfer of title in one sitting. After entry into the real estate register, the electronic real estate title certificate will be issued to the new corporate titleholder, while the hardcopy certificate will be delivered via EMS courier free of charge.

  2.1. Submission of application. The seller shall log on to the system through identity verification, complete the applications for registration of property transfer and tax verification, and upload the application documents (among the application documents, the real estate registration application form and transaction contract need not be uploaded as they may be electronically generated upon completed online with electronic seals affixed, while the application form should include relevant information for the delivery of hardcopy certificate; documents that can be obtained through shared databases of the system need not be uploaded; other required documents should be uploaded in PDF format, which must include all pertinent content, all pages, and be scanned in color). The application shall be submitted after the online verification of its content by both parties to the transaction.

  2.2. Concurrent verification. The system will forward submitted application information to registration authorities and taxation authorities for concurrent verification. Taxation authorities will immediately forward the outcomes of tax verification to registration authorities. Where both parties have passed the verification procedures, the system will forward payment information for applicable taxes and fees to the applicants. Where verification is unsuccessful, the system will send a message requesting the applicants to make the required amendments.

  2.3. Registration of tax payment. After the enterprises have paid taxes and registration fees online, registration authorities will retrieve relevant tax payment information and complete application acceptance, verification, and title registration directly using relevant electronic documents based on relevant regulations for real estate registration. Registration personnel will concurrently issue a public notice revoking the original real estate title certificate on the website of Guangzhou Municipal Planning and Natural Resources Bureau in accordance with prevailing regulations.

  2.4. Certificate issuance.After the completion of title registration, enterprises may directly obtain their electronic real estate registration certificates through the system, while hardcopy certificates may be delivered through EMS courier. After the completion of the service, registration authorities will print and file relevant electronic documents. The application information, tax payment information, and registration outcomes during the process will be stored on the system. Parties to the transaction are not required to submit hardcopy documents.

  3. Processing Time

  Where an applicant submits the application for the service before 16:00 on a working day, taxation authorities and registration authorities are, in principle, required to complete concurrent verification on the same day. Where an applicant completes tax payments and obtains relevant certification before 16:00 on a working day, registration authorities are, in principle, required to complete case approval and title registration on the same day.

  Where an applicant submits the application or completes relevant tax payments after 16:00 on a working day, the corresponding completion deadline will be extended to the next working day.

  4. Work Requirements

  4.1. Enhancing awareness and strengthening recommendation.All departments should regard “full online processing” of the registration of the transfer of existing non-residential property between enterprises as a key task in optimizing the business environment and enhancing government performance. All departments should take the initiative to launch “one-on-one” publicity efforts, and promptly publicize service guidelines through official media channels and display panels at service centers, so as to increase public awareness of new policy measures, and encourage enterprises to voluntarily opt for and experience the efficiency and convenience of these new measures.

  4.2. Appointing dedicated staff and responding proactively.All departments should ensure that dedicated personnel are familiarized with the use of the new functions as quickly as possible, strengthen service training for frontline personnel, appoint dedicated consultants to promptly address issues faced by enterprises during applications and achieve “on-the-spot processing of applications and on-the-spot answering of queries,” in order to ensure enterprises are comfortable with using the new functions.

  4.3. Strengthening inspections and ensuring solid outcomes.Municipal real estate registration authorities and taxation authorities will conduct joint inspections on the promotion and implementation of online processing for these services in various districts. Notices of criticism will be circulated if these measures are found to have been inadequately implemented during the course of inspections, which will be an important basis for relevant evaluations and assessments. Government affairs data administrations should ensure that relevant functions such as electronic signature are operational and properly maintained.
